This is a workmens compensation suit. Henry Vaughn sought to recover compensation from Traders & General Insurance Company for an alleged accidental injury to his back sustained on April 11, 1956, while in the employ of Foree Drilling Company. The case was tried before a jury which found that Vaughn did suffer the alleged injury and as a result sustained total incapacity to work for a period of 35 weeks and thereafter suffered or will suffer a 40 percent partial incapacity for a period of 156 weeks. Traders & General Insurance Company has appealed from the judgment entered on the verdict.
